The federal government has been targeting real estate agents for some time. Purchase prices and rents for private consumers have risen sharply in recent years, especially in urban areas. In order to somehow curb the rise in prices, it is not only landlords who have been legally obliged to do so by means of the so-called rental price brake. The broker was also identified by politicians as a natural enemy of the consumer. Initially, the brokerage commission for rentals was regulated by law. This may no longer be required by the tenant, but must be borne by the landlord. This rule is often referred to as the “ordering principle”.

How does this affect real estate agents?

A new bill now also regulates the assumption of the brokerage commission for private property buyers. The restrictions are not quite as rigid as in the mediation of leases, at least half of the broker’s commission can be transferred to the buyers in the future. Nevertheless, many sellers will probably decide to give up a real estate agent and save on brokerage compensation. Almost as serious as the actual impact of the new brokerage regulation is likely to be the damage to the image. In the media coverage triggered by the discussion about the new bill, the broker increasingly mutates into the enemy of consumers, which must be combated. None of these are good prospects for real estate agents!
